利用規約Terms of Service

本利用規約（以下「本規約」）は、Focusity の開発者（以下「当方」）が提供するアプリ「Focusity」（以下「本アプリ」）の利用条件を定めるものです。本アプリを利用することで、本規約に同意したものとみなされます。 These Terms of Service (the “Terms”) set out the conditions for using the Focusity app (the “App”) provided by the developer of Focusity (“we,” “us”). By using the App, you agree to these Terms.

1本規約への同意Acceptance of Terms

本アプリのダウンロード・利用にあたっては、本規約およびプライバシーポリシーPrivacy Policyに同意いただく必要があります。同意いただけない場合は、本アプリをご利用いただけません。 To download and use the App, you must agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2サービス内容The Service

本アプリは、集中したい時間に指定したアプリをブロックする集中タイマーと、入力した言葉から街のジオラマを AI が生成する「クラフト」機能を提供します。当方は、事前の通知なく機能の追加・変更・停止を行うことがあります。 The App provides a focus timer that blocks selected apps during focus sessions, and a “Craft” feature that uses AI to generate city dioramas from the words you enter. We may add, change, or discontinue features without prior notice.

3AI 生成コンテンツに関する条項AI-Generated Content

3.1 仕組みと同意3.1 How it works & consent

「クラフト」機能で生成される画像は、Google の生成 AI「Gemini」によって作成されます。あなたが入力したテーマと選択したスタイルは、画像生成のために Google へ送信されます。本機能の利用には、この AI 処理への明示的な同意が必要です。同意はアプリ内で初回利用時に取得します。 Images created by the “Craft” feature are generated by Google’s generative AI, Gemini. The theme you enter and the style you select are sent to Google to generate images. Using this feature requires your explicit consent to this AI processing, obtained in-app before first use.

3.2 入力（プロンプト）に対する責任3.2 Responsibility for your inputs

あなたが入力するテーマ・言葉について、あなたが全責任を負うものとします。以下に該当する入力を行ってはなりません。You are solely responsible for the themes and words you enter. You must not submit inputs that:

第三者の著作権・商標・肖像権・その他の権利を侵害する内容。infringe the copyright, trademark, likeness, or other rights of third parties;
実在の人物・著名なキャラクター・登録商標を不正に再現しようとする内容。attempt to reproduce real individuals, well-known characters, or registered trademarks without authorization;
違法、暴力的、差別的、わいせつ、その他他者に有害・不快を与える内容。are illegal, violent, discriminatory, obscene, or otherwise harmful or offensive;
虚偽の情報の生成や、他者を欺く目的での利用。are intended to generate misinformation or to deceive others.

3.3 生成物の権利と取り扱い3.3 Rights in outputs

適用される法令の範囲内で、当方は、あなたが本アプリで生成した画像を個人的に利用する権利をあなたに付与します。ただし、次の点にご留意ください。 To the extent permitted by applicable law, we grant you the right to use the images you generate in the App. Please note the following:

AI 生成物は唯一性が保証されません。同一・類似のテーマから、他の利用者に対して似た、または同一の結果が生成される場合があります。AI outputs are not guaranteed to be unique. Similar or identical results may be generated for other users from the same or similar themes.
純粋に AI によって生成されたコンテンツは、法域によっては著作権による保護が認められない場合があります。Purely AI-generated content may not be eligible for copyright protection in some jurisdictions.
第三者（Google を含む）の規約が、生成物の利用にあたり別途適用される場合があります。Third-party terms (including Google’s) may also apply to your use of outputs.

3.4 現状有姿（保証の否認）3.4 Provided “as is”

AI による生成結果は現状有姿で提供されます。当方は、生成物の正確性・適法性・特定目的への適合性・非侵害性について、いかなる保証も行いません。生成には数分かかる場合があり、必ず成功するとは限りません。 AI outputs are provided “as is.” We make no warranty as to the accuracy, legality, fitness for a particular purpose, or non-infringement of outputs. Generation may take several minutes and may not always succeed.

3.5 商用利用3.5 Commercial use

生成物を商用目的で利用する場合は、関連する法令および第三者の規約・権利を遵守する責任があなたにあります。商用利用の可否・安全性について当方は保証しません。 If you use outputs commercially, you are responsible for complying with applicable laws and any third-party terms and rights. We do not warrant the permissibility or safety of commercial use.

4生成チケットGeneration Tickets

AI による街の生成には、アプリ内の「チケット」を消費します。チケットの付与数・消費条件は予告なく変更されることがあります。消費済みのチケットの払い戻しは、原則として行いません。 Generating a city with AI consumes in-app “tickets.” The number granted and the conditions for use may change without notice. Used tickets are generally non-refundable.

5禁止行為Prohibited Conduct

利用者は、次の行為を行ってはなりません。You must not:

本アプリのリバースエンジニアリング、改変、不正アクセス。reverse engineer, modify, or gain unauthorized access to the App;
サーバーに過度な負荷をかける行為、自動化による大量リクエスト。place excessive load on our servers or send automated bulk requests;
本アプリを違法な目的、または他者の権利を侵害する目的で利用する行為。use the App for illegal purposes or to infringe the rights of others;
本規約または適用される法令に違反する行為。violate these Terms or any applicable law.

6知的財産権Intellectual Property

本アプリ、そのアイコン、デザイン、ロゴ、サンプル画像、その他の素材に関する知的財産権は、当方または正当な権利者に帰属します。本規約は、これらの権利をあなたに移転するものではありません。 Intellectual property rights in the App, its icon, design, logo, sample images, and other materials belong to us or the respective rights holders. These Terms do not transfer those rights to you.

7免責事項・責任の制限Disclaimers & Limitation of Liability

本アプリは現状有姿で提供され、当方は本アプリが常に中断なく、エラーなく動作することを保証しません。適用される法令で認められる最大限の範囲で、当方は、本アプリの利用または利用不能から生じるいかなる間接的・付随的・結果的損害についても責任を負いません。 The App is provided “as is,” and we do not warrant that it will operate uninterrupted or error-free. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the App.

8サービスの変更・中断・終了Changes, Suspension & Termination

当方は、本アプリおよび本規約を、必要に応じて変更・中断・終了することがあります。本規約の重要な変更は、本ページ上で更新日を改めることにより通知します。変更後に本アプリを継続して利用した場合、変更後の規約に同意したものとみなされます。 We may change, suspend, or terminate the App and these Terms as needed. Material changes to these Terms will be notified by updating the date on this page. Continued use of the App after changes constitutes acceptance of the revised Terms.

9準拠法・裁判管轄Governing Law

本規約は日本法に準拠して解釈されます。本アプリに関連して紛争が生じた場合は、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。 These Terms are governed by and construed in accordance with the laws of Japan. Any disputes relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
